These Terms & Conditions (“Agreement”) govern your access to and use of the websites, content, and services provided by Enlightenment Planner LLC (“Enlightenment Planner,” “we,” “us,” or “our”), including www.enlightenmentplanner.com and any related features (collectively, the “Sites”), as well as your purchase of any Enlightenment Planner products (each, a “Product”).
By using the Sites and/or purchasing a Product, you agree to be bound by this Agreement, including the arbitration and class-action waiver in Section 17. If you do not agree, do not use the Sites or purchase Products.
1) Eligibility
The Sites are intended for individuals 13 years or older. If you are between 13–18, you represent you have parental permission. We may refuse the Sites or Services to anyone at any time.
2) Changes to These Terms or the Sites
We may update this Agreement, modify features, or discontinue parts of the Sites at any time. When we post changes, the “Last updated” date will change. Your continued use constitutes acceptance of the updated terms.
3) Privacy
We care about your privacy. Please review our Privacy Policy (incorporated by reference) before using the Sites or providing information.
4) Intellectual Property
All content on the Sites (text, graphics, logos, images, page headers, designs, compilations, and software) is owned by Enlightenment Planner or its licensors and is protected by IP laws. You may print or download materials for personal, non-commercial use only and must retain all proprietary notices. No other rights are granted.
Trademarks, trade dress, service marks, and logos (including Enlightenment Planner) may not be used without our prior written consent.
5) User Submissions & License
If you submit content (e.g., comments, ideas, feedback, photos) (“Submitted Items”), you grant Enlightenment Planner an irrevocable, perpetual, worldwide, royalty-free, sublicensable license to use, reproduce, modify, publish, display, distribute, and create derivative works from those Submitted Items in any media, for any business purpose, without compensation. You represent you own or control all rights in your Submitted Items and that our use will not infringe third-party rights. We may, but are not obligated to, monitor or remove Submitted Items.
6) Acceptable Use
You agree not to:

Violate any law; infringe others’ rights; upload unlawful, harmful, defamatory, obscene, or hateful content;

Transmit viruses or malicious code;

Impersonate others; collect data from the Sites by automated means (crawlers, scrapers) without permission;

Overload or interfere with the Sites’ operation; reverse engineer the Sites except as permitted by law.
We may suspend or terminate access for violations.
7) Links, Frames, and Feeds
You may link to public pages of the Sites (not behind login) in a way that is fair and not misleading. You may not frame our pages or use our marks without written consent. We may change or disable RSS feeds or other features at any time.
8) Product Orders (Terms of Sale)
Binding Orders. Orders placed through the Sites are binding. Quantities are firm. You may not cancel or modify an order except as stated here.
Pricing & Payment. You agree to pay the price listed at checkout and authorize us (or our payment processor) to charge your selected payment method.
Transfer of Risk & Title. Risk of loss to a Product passes to you upon our delivery to the carrier. Title passes upon our receipt of your payment.
Cancellations & Refunds. At our discretion, you may cancel at least 15 days before the shipment date for a full refund by emailing contact@enlightenmentplanner.com.
Personal Use Only. Products are for personal, non-commercial use. No resale. You may not reverse engineer Products or use them to create competitive products.
9) Replacement of Faulty Products (Returns)
If you believe a Product is defective or damaged, contact contact@enlightenmentplanner.com within 15 days of receipt for instructions. We may accept returns of defective/damaged goods if notified within that window and the defect was not caused after shipment or by misuse. Follow our return procedures. Replacements ship after we receive and verify the returned item.
10) No Medical or Professional Advice
Content on the Sites (including wellness, mindfulness, or meditation content) is for informational purposes only and is not medical or professional advice. Consult a qualified professional for guidance specific to you.
11) Disclaimer of Warranties
EXCEPT TO THE EXTENT REQUIRED BY LAW, THE SITES, SERVICES, CONTENT, AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS.
WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
We do not warrant the Sites will be error-free, secure, or available at all times.
(Some jurisdictions do not allow disclaimer of implied warranties; the above may not apply to you to that extent.)
12) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:

For Site/Service/Content claims: We will not be liable for indirect, incidental, special, consequential, punitive, or reliance damages, or direct damages in excess of $1 in the aggregate.

For Product claims: Our total liability shall not exceed the purchase price you paid for the Product that gave rise to the claim.
These limits apply whether based in contract, tort (including negligence), strict liability, or otherwise, even if advised of the possibility of damages. Some jurisdictions do not allow certain limitations; in such cases, liability is limited to the minimum extent permitted by law.
13) Indemnification
You agree to defend, indemnify, and hold harmless Enlightenment Planner and its officers, directors, employees, agents, affiliates, licensors, and suppliers from any claims, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising from: (a) your use of the Sites, Services, or Products contrary to this Agreement; (b) your Submitted Items; or (c) your violation of any law or third-party right.
14) Force Majeure
We are not liable for delays or failure to perform due to causes beyond our reasonable control, including acts of God, labor disputes, internet or utility failures, supplier issues, or governmental actions.
15) Assignment; Notices; Entire Agreement
You may not assign this Agreement without our prior written consent. We may assign or delegate our rights and obligations without consent. Notices to us must be sent to contact@enlightenmentplanner.com. This Agreement (including the Privacy Policy) is the entire agreement between you and us and supersedes all prior or contemporaneous communications.
16) Governing Law & Venue (Outside of Arbitration)
This Agreement is governed by the laws of the State of California, without regard to conflicts-of-law rules. Subject to Section 17, for any matter that may be brought in court (e.g., to enforce an arbitration award or for claims that qualify for small claims court), the state and federal courts located in Los Angeles County, California shall have exclusive jurisdiction and venue, and you consent to personal jurisdiction there.
17) Dispute Resolution; Binding Arbitration; Class-Action Waiver
PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR RIGHTS.

Arbitration. Any dispute, claim, or controversy arising out of or relating to this Agreement, the Sites, Services, or Products shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration will take place in Los Angeles, California, before a single arbitrator. The Federal Arbitration Act (FAA) governs the interpretation and enforcement of this Section. The arbitrator may award all remedies available under applicable law.

Individual Basis Only. YOU AND WE AGREE THAT CLAIMS MAY ONLY BE BROUGHT IN AN INDIVIDUAL CAPACITY and NOT as a plaintiff or class member in any purported class, collective, representative, or mass action. The arbitrator may not consolidate claims without all parties’ consent.

Small Claims Option. You may bring an individual claim in small claims court with appropriate jurisdiction instead of arbitration.

Fees. Each party shall bear its own costs and attorneys’ fees, unless the arbitrator determines otherwise under applicable law.
18) Termination
We may, without notice, suspend or terminate your access to the Sites or Services for any reason. Sections that by their nature should survive termination (e.g., IP, disclaimers, limitations of liability, arbitration, indemnity) survive.
19) Miscellaneous
If any provision is held unenforceable, it will be modified to the minimum extent necessary to be enforceable, and the remainder will remain in effect. Our failure to enforce any provision is not a waiver. Headings are for convenience only.
